These Terms of Service ("Terms") govern your access to and use of the Airmark Customer Portal operated by Airmark Aviation. By accessing or using the portal, you agree to these Terms.
Service description
The portal provides aircraft owners and authorized users with access to aircraft profiles, estimated times, inspection tracking, maintenance status, compliance reports, and related account features. Some features require a paid subscription or separate invoice.
Aviation and maintenance disclaimer
THE PORTAL IS PROVIDED FOR INFORMATIONAL AND CONVENIENCE PURPOSES ONLY. IT IS NOT A REPLACEMENT FOR OFFICIAL AIRCRAFT LOGBOOKS, MAINTENANCE RECORDS, REGULATORY DOCUMENTATION, OR PROFESSIONAL MAINTENANCE ADVICE.
Inspection status, AD compliance summaries, estimated times, ADS-B-derived data, and other portal content may be incomplete, delayed, or inaccurate. You are solely responsible for verifying all maintenance, airworthiness, and regulatory requirements with qualified personnel and official records before operating any aircraft.
Airmark Aviation does not guarantee that use of the portal satisfies any FAA, manufacturer, insurer, or operator requirement.
Eligibility and accounts
Access is provided by invitation or registration through email addresses authorized by Airmark. You must provide accurate information, keep credentials secure, and notify us of unauthorized access. You are responsible for activity under your account.
Subscriptions and billing
Certain aircraft services require a recurring subscription or one-time fees processed through Stripe. By completing checkout or paying an invoice, you authorize us and Stripe to charge the selected payment method.
- Subscription tiers, pricing, and included features are described at checkout or in communications from Airmark.
- Recurring subscriptions renew automatically until canceled through the Stripe Customer Portal or as otherwise instructed by Airmark.
- One-time fees such as onboarding or custom service invoices are due as stated on the invoice.
- Taxes, payment failures, chargebacks, and refunds are handled according to applicable law, Stripe policies, and Airmark billing practices communicated to you.
- Failure to pay may result in suspension of paid features while preserving access necessary for safety-related informational records where appropriate.
Acceptable use
You agree not to:
- Access or attempt to access aircraft or data you are not authorized to view.
- Interfere with portal security, scrape data in bulk, or reverse engineer the service except as permitted by law.
- Upload malicious code or use the portal for unlawful purposes.
- Misrepresent your identity or relationship to an aircraft or customer account.
Intellectual property
The portal, branding, software, and content provided by Airmark Aviation are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the portal for its intended purpose while your access remains active.
Third-party services
The portal integrates with third-party services including Clerk, Stripe, email providers, and external aviation data sources. Your use of those services may be subject to separate terms and privacy policies. Airmark is not responsible for third-party outages or policies outside our control.
Disclaimer of warranties
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRMARK AVIATION AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR AIRCRAFT OPERATIONAL LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE PORTAL.
Our total liability for any claim arising out of these Terms or the portal will not exceed the greater of (a) the amount you paid to Airmark for portal-related services in the twelve months before the claim or (b) one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold harmless Airmark from claims, damages, and expenses arising from your misuse of the portal, violation of these Terms, or operation of an aircraft based solely on portal information without appropriate verification.
Suspension and termination
We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, or if continued access is no longer appropriate. You may stop using the portal at any time. Sections intended to survive termination will remain in effect.
Changes
We may modify these Terms or portal features at any time. Material changes will be indicated by updating the "Last updated" date. Continued use after changes become effective constitutes acceptance.
Governing law
These Terms are governed by the laws applicable to Airmark Aviation's place of business, without regard to conflict-of-law rules. Any dispute will be brought in the courts located in that jurisdiction, unless otherwise required by applicable law.
